Senior Samajwadi Party leader Azam Khan on Monday asked the Supreme Court to hear his plea against the Enforcement Directorate's action, taken outside Rampur jail immediately after he was released on bail, The Hindu reported.

Advocate Nizam Pasha, appearing for the 78-year-old leader, made an oral mention before Chief Justice of India Surya Kant and sought a hearing this week.

"It was an illegal arrest in a seven-year-old FIR. The purpose is to delay his eventual release," Pasha submitted, according to the report. He said 87 FIRs had been filed against his client and this was the 88th, called it part of what the Supreme Court had earlier described as "evergreening of cases", and argued that the action had the Uttar Pradesh Assembly elections in mind.

What the court said

The Chief Justice said that since Khan's release had come through an Allahabad High Court order, he ought to approach the High Court rather than come directly to the Supreme Court.

"Have faith in the High Court, it has given him relief. We will relegate this matter to the High Court and request it to take it up without delay," the CJI said, The Hindu reported. When Pasha urged the court to list the petition and then decide, the CJI said: "We will list it this week."

How it got here

The sequence moved quickly over four days:

  • On October 29, the Allahabad High Court suspended the sentences of Khan and his son Abdullah Azam Khan in the dual PAN card case and granted them bail. It refused to stay their conviction, Free Press Journal reported.
  • On October 31, the ED detained Khan outside Rampur jail as soon as he came out, The Hindu reported.
  • On November 1, a special PMLA court in Ghaziabad sent him to 14-day judicial custody. The ED said it had arrested him on October 31 under the money laundering law.

The case against him

The ED's probe rests on 26 FIRs registered at Azeem Nagar police station in Rampur in July 2019, The Hindu reported. They allege that farmers' land in Singankhera village was forcibly occupied for Mohammad Ali Jauhar University, of which Khan is chancellor, and that farmers were coerced into executing sale deeds.

The ED has also alleged that funds meant for public works were diverted to the university, according to the report. Days before the arrest, it attached the university's land and buildings, Free Press Journal reported.

These are allegations, and Khan's side disputes the action. SP president Akhilesh Yadav called it a "cowardly act" and said the cases were "frivolous", while senior SP leader Sudhir Panwar said it smacked of political vendetta, The Hindu reported.
