The Chief Justice said the matter should go to the Allahabad High Court but agreed to list the plea this week, days after the SP leader's release on bail.
Azam Khan's lawyer sought an urgent hearing in the Supreme Court on Monday against his detention by the ED outside Rampur jail, The Hindu reported.
CJI Surya Kant said he ought to approach the High Court, but agreed to list the plea this week.
The ED says it arrested him on October 31 in a money laundering case, and a PMLA court has sent him to 14-day judicial custody.
